Conditions of Sale
#1.) Announcements: Announcements made by the auctioneer or posted on the website on the day of the Auction take precedence over any printed material or other information previously disseminated.
#2.) Buyer’s Premium: There will be an 8% buyer’s premium placed on all equipment sales.
#3.) All Bids: Are Subject to Approval and Acceptance by Board of Directors of selling company.
#4.) Equipment: All equipment is sold “As Is Where Is”, with no warranties.
#5.) Prior Sale: All equipment is Subject to Prior Sale.
#6.) Sales Tax: If any is applicable, will be the responsibility of the Buyer.
#7.) Disclaimer: In consideration of information contained in this advertising and on the website, data utilized was secured from sources believed to be reliable. However, no responsibility is assumed as to the accuracy of such information, and/or the condition of the railcars. All buyers are responsible for their own inspections.

#9.) Terms of Payment: Successful bidder will be required to deposit 10% of sale price in United States Dollars on the day of the auction into the D. F. Barnhardt & Associates escrow account. The remaining funds must be paid to D. F. Barnhardt & Associates within 14 days of acceptance by the Board of Directors of selling company unless other suitable arrangements are made between Seller and Purchaser. Should buyer default on final payment, deposit will be forfeited.
#10.) Wire Transfer Instructions: Monies may be wired into the D. F. Barnhardt & Associates Escrow Account through First Charter Bank (an on line Bank with US Federal Reserve) 10200 David Taylor Drive, Charlotte, NC 28262, ABA Routing #053100737 for credit to DFB&A Escrow Account #014003937.
#11.) Removal of Equipment: The purchaser is responsible for removal of the equipment from its present location by June 15, 2004. For storage beyond June 15, arrangements must be made between purchaser and storage site managers. Any risks and/or costs associated with storage after June 15, and movement from current storage site will be the responsibility of the purchaser.
